Dark Iron Society – Membership Agreement

Release of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of participating in training and use of facilities at Dark Iron Society, I represent that I understand the nature of these activities and that I am qualified, in good health, and in proper physical condition to participate in such activities. I acknowledge that if I believe any workouts, equipment, or conditions are unsafe for me or my family, I will immediately discontinue participation.

I fully understand that participation in activities at Dark Iron Society involves risk of serious bodily injury, including permanent disability, paralysis, and death, which may result from my own actions, inactions, or those of others, or from conditions of the facility or equipment.

I fully accept and assume all such risks and all responsibility for losses, costs, and damages I may incur as a result of participation in activities at Dark Iron Society.

I hereby release, discharge, and agree not to sue Dark Iron Society, its owners, employees, volunteers, or affiliates from any liability, claims, demands, losses, or damages caused in whole or in part by my own negligence or otherwise. This includes negligent rescue operations. I further agree that if, despite this release, I or anyone on my behalf makes a claim against any party released herein, I will indemnify and hold harmless each of them from any loss, liability, damage, or cost, including legal fees.

For Minors

As the parent or legal guardian of the participating minor, I understand the nature of the activities at Dark Iron Society and believe the minor to be qualified to participate. I release, discharge, and agree to indemnify and hold harmless Dark Iron Society, its owners, employees, and volunteers from all liability, claims, demands, or damages on the minor’s account caused by negligence or otherwise. I also agree to defend them from any such claims brought by or on behalf of the minor.

Terms and Conditions

Membership at Dark Iron Society is conditioned on full compliance with the following rules to ensure safety, order, and enjoyment for all members.

- Eligibility: Members must be at least 13 years old to train. Those aged 16+ may train without a guardian if they hold a valid driver’s license.
- Private Facility Rights: Dark Iron Society is a private, members-only facility. Management reserves the right to refuse, suspend, or cancel memberships without stated cause.
- Agreement to Rules: By signing this agreement, members agree to abide by all gym rules and conduct policies. The gym reserves the right to update these terms with advance notice.
- Access Control: Entry is allowed only with an active, paid membership through the official Dark Iron Society access app. Members with outstanding balances will be denied access. Sharing login credentials, screenshots, or otherwise allowing non-members to enter using your access is strictly prohibited and will result in an automatic $25 violation fee. Repeated violations may result in termination without refund.
- Liability & Insurance: Members are encouraged to carry personal insurance for injury, damage, or loss incurred while using the facility. Participation is voluntary and at your own risk.
- Reporting Issues: To report accidents, unsafe conditions, or concerns, please contact staff during office hours or email darkironsociety@gmail.com.
- Breach of Rules: Any violation of rules, illegal acts (including theft or theft of services), or conduct deemed unsafe or inappropriate will result in immediate expulsion and permanent banning from the premises.

Code of Conduct

Members are expected to respect other members, staff, and the facility. The following behaviors will not be tolerated and may result in immediate termination without refund:
- Inappropriate behavior, harassment, explicit photos, unsafe conduct, or loitering.
- Spitting, nicotine use, excessive profanity, or racial slurs.
- Dropping weights intentionally unless in designated safe areas.
- Failure to re-rack weights or return equipment after use.
- Unauthorized guests or sharing of app access credentials.

Membership Commitment & Payments

- Membership Commitment: All memberships are a 12-month commitment. Early cancellation requires a $150 fee unless you move more than 25 miles away (with proof) or provide valid medical documentation.
- Automatic Payments: Monthly memberships are billed via debit/credit card on or around the join date each month. A minimum two-month membership is required.
- Late Payments: Failed payments will incur a $20 late fee. Membership access will be suspended until balances are paid.
- Chargebacks: Any chargebacks filed without first contacting the gym will result in a $25 administrative fee in addition to unpaid dues.
- Violation Fees: Guest fees, late fees, or administrative fees will be automatically charged to the card on file and must be paid in full before access is restored.
- Collections: Balances unpaid after 30 days may be sent to collections, with all costs the responsibility of the member.

No Refunds

Membership dues and fees are non-refundable under all circumstances, including suspension or termination for cause. Prepaid dues, fees, or penalties will not be refunded or prorated. If membership is terminated for cause, all prepaid dues are forfeited.

Guest Policy

Guests may purchase a $10 day pass during office hours and must sign a waiver before using the facility. Guest passes are valid only on the day of purchase. Guests may not enter the facility using a member’s access credentials.

Any unauthorized guest will result in an automatic $25 violation fee charged to the responsible member’s account per occurrence. Repeated violations may result in immediate termination without refund.

Guests who attempt to allow unpaid individuals into the facility will be permanently denied future guest access. The responsible party will be billed $25 per unpaid individual. Dark Iron Society reserves the right to treat this as theft of services and pursue collection of unpaid fees.

Lockers & Personal Belongings

Lockers are available for day use only and may not be used overnight. Items left overnight may be removed. Locks left on longer than 24 hours will be cut, and contents moved to lost and found. Dark Iron Society is not responsible for lost or stolen personal items.

Hours of Operation

Gym Access: 24/7 with valid door access

Staffed Office Hours:
- Mon–Thurs: 8 AM–1 PM & 3 PM–7 PM
- Fri: 8 AM–1 PM & 3 PM–5:30 PM
- Sat: 8 AM–11:30 AM
- Sunday: Closed

Safety & Hygiene

- Members must wipe down equipment after use.
- Wear clean attire and proper footwear at all times.
- Shirts and shoes are required.
- Stop exercising immediately if you feel dizzy, faint, or experience unusual pain.
- If unsure how to use equipment, request an orientation.
- All members are expected to maintain cleanliness and hygiene.
- Bathrooms and showers must be used responsibly. No leaving items or trash behind. Showers are for individual use only. Any inappropriate behavior will result in immediate termination.
- Children must be accompanied by a parent or legal guardian in bathroom areas.

Social Media & Communication Terms

All membership rules extend to Dark Iron Society’s social media platforms. By interacting with our social media pages, you agree to these terms. The gym reserves the right to take disciplinary action for inappropriate online conduct. Dark Iron Society is not responsible for third-party content linked to our platforms.

Legal Disclaimers

Content shared by Dark Iron Society, including fitness advice or programs, is offered "as-is" and without guarantees. We are not liable for damages or losses, including financial loss, interrupted training, or injury. These terms are governed by the laws of the state of Georgia. If any part of this agreement is deemed invalid, the remaining provisions shall remain in full effect.
