DARK IRON SOCIETY CHILDCARE WAIVER & RELEASE OF LIABILITY
For use of supervised childcare services at Dark Iron Society Gym
This agreement is entered into by the undersigned parent/legal guardian (“Parent”) and Dark Iron Society (“Gym”) for the provision of non-licensed, short-term supervised childcare services for minor children during the Parent’s use of the facility.
1. Acknowledgment of Services Provided
I understand that the childcare area at Dark Iron Society is provided as a courtesy service for members and is intended for short-term, supervised care while I am actively using the gym. This service is not licensed childcare under state law and should not be considered as such.
2. Assumption of Risk & Waiver of Liability
I acknowledge that leaving my child(ren) in the care of gym staff, volunteers, or designated childcare supervisors involves inherent risks. I hereby voluntarily release, discharge, and hold harmless Dark Iron Society, its owners, employees, agents, volunteers, and affiliates from any and all claims, demands, losses, liabilities, damages, or costs arising out of or related to any injury, illness, accident, or incident involving my child(ren) while in the childcare area, whether arising from ordinary negligence or otherwise.
I assume full responsibility for any risk of bodily injury, allergic reaction, emotional distress, or property damage associated with my child’s participation.
3. Emergency Medical Authorization
In the event that I cannot be reached during an emergency involving my child(ren), I hereby authorize Dark Iron Society staff or agents to obtain emergency medical care and treatment, including transport to a medical facility, for my child(ren). I agree to be financially responsible for all medical services rendered.
4. Child Illness & Health Policy
I agree that I will not bring my child(ren) to the childcare area if they exhibit any of the following:
- Fever over 100.4°F
- Vomiting or diarrhea within the last 24 hours
- Persistent cough, excessive nasal discharge, or suspected contagious illness
- Any communicable skin condition (e.g., ringworm, impetigo, lice)
Dark Iron Society reserves the right to refuse care or request early pickup if any signs of illness or behavioral issues arise during a visit.
5. Behavior Expectations
I acknowledge that Dark Iron Society is not equipped to provide individualized care for children with significant behavioral or developmental challenges. I understand that:
- Children must remain within the designated childcare area.
- Aggressive or disruptive behavior (biting, hitting, etc.) will result in immediate parent notification.
- Repeated behavioral concerns may result in revocation of childcare privileges.
6. Sign-In/Sign-Out & Supervision Policy
- Children must be signed in and out by a parent or authorized guardian aged 18 or older.
- Children will only be released to the individuals listed on this waiver.
- Parents must remain on the premises of Dark Iron Society at all times while their child is in care.
- Maximum stay per visit is 90 minutes, unless otherwise approved.
7. Items from Home
Dark Iron Society is not responsible for lost, damaged, or stolen personal items. Please label any items brought in, and avoid sending toys, electronics, or valuables.
8. Indemnification
I agree to indemnify and hold harmless Dark Iron Society, its agents, employees, and volunteers from any claims, liabilities, damages, or expenses arising out of or in connection with the participation of my child(ren) in the childcare services, including any third-party claims related to my child’s behavior or conduct.
9. Photography and Media Release (Optional)
I give permission for Dark Iron Society to take photographs or short video clips of my child(ren) in the childcare area for marketing or promotional purposes.
I do not give permission.
10. General Acknowledgments
- I have read and understood this waiver in its entirety.
- I understand that childcare services are limited to potty-trained children between the ages of 2/3 and 10 years old.
- I affirm that the information provided is accurate and complete.
- I agree to follow all posted rules and staff directions related to the childcare area.
